چکیده

هدف از این پژوهش تحلیل کیفی چالش‌ها و راهکارهای حقوقی و اجرایی خصوصی‌سازی اماکن ورزشی بر اساس ماده 27 بود. روش تحقیق کیفی با رویکرد براون و کلارک (2006) انجام شد. جامعه آماری شامل 15 نفر از خبرگان، متخصصان و کارشناسان وزارت ورزش و جوانان و اداره کل ورزش و جوانان بود. ابزار تحقیق مصاحبه نیمه ساختاریافته بود.اعتبار سنجی با استفاده از رویکرد (گوبا و لینکلن ، 1989). انجام شد. چالش های حقوقی ماده 27 ورزش شامل 6 تم اصلی (چالش های فرایندی، چالش های مالکیتی، چالش های قانونی، چالش های اجتماعی، چالش های اقتصادی و چالش های سازمانی) و 49 تم فرعی بود. چالش های اجرایی ماده 27 ورزش شامل 6 تم اصلی (چالش های مدیریتی، چالش های نظارتی، چالش های عمومی، چالش های مالی و اقتصادی، چالش های فناوری و دیجیتالی و چالش های زیست محیطی) و 43 تم فرعی بود. راه کارهای مقابله با چالش های ماده 27 ورزش شامل 4 تم اصلی (راه کارهای مالی و اقتصادی، راه کارهای نظارتی و اداری، راه کارهای قانونی و قرار دادی و راه کارهای مقابله با چالش های اجرایی) و 42 تم فرعی بود. بر اساس یافته‌ها، اجرای ماده 27 ورزش با چالش‌های حقوقی و اجرایی متعددی مواجه است. راهکارهای عملیاتی پیشنهادی شامل: ارزیابی دقیق ارزش دارایی‌ها، تشکیل نهادهای نظارتی مستقل، تنظیم قوانین حمایتی، استفاده از فناوری‌های دیجیتال، و طراحی برنامه‌های عملیاتی کوتاه و بلندمدت می‌باشد.

چکیده [English]

The purpose of this study was to conduct a qualitative analysis of the legal and implementation challenges and proposed solutions for the privatization of sports facilities under Article 27. The qualitative research method was conducted with the approach of Brown and Clark (2006). The statistical population consisted of 15 experts, specialists, and experts from the Ministry of Sports and Youth and the General Directorate of Sports and Youth. The research tool was a semi-structured interview. Validation was conducted using the approach (Guba and Lincoln, 1989). The legal challenges of Article 27 of Sports included 6 main themes (process challenges, ownership challenges, legal challenges, social challenges, economic challenges, and organizational challenges) and 49 sub-themes. The implementation challenges of Article 27 of Sports included 6 main themes (management challenges, regulatory challenges, public challenges, financial and economic challenges, technological and digital challenges, and environmental challenges) and 43 sub-themes. The solutions to address the challenges of Article 27 of the Sport Law included 4 main themes (financial and economic solutions, regulatory and administrative solutions, legal and contractual solutions, and solutions to address implementation challenges) and 42 sub-themes. Based on the findings, the implementation of Article 27 of the Sport Law faces numerous legal and implementation challenges. The proposed operational solutions include: accurate assessment of asset value, establishment of independent regulatory bodies, regulation of supportive laws, use of digital technologies, and design of short- and long-term operational plans.
