چکیده

اساساً تبانی سبب از بین رفتن هیجان رقابت‌های ورزشی، کاهش حمایت شرکت‌های تجاری، به‌وجود-آمدن ذهنیت منفی و در نهایت کاهش مشارکت علاقه‌مندان به ورزش میشود. هدف پژوهش حاضر آسیب‌شناسی حقوقی تبانی در فوتبال ایران بود. براساس محتوای موضوع و اهداف پژوهش به صورت کیفی و مبتنی بر نظریه داده‌بنیاد است. جامعه آماری پژوهش شامل خبرگان فوتبال در بخش حقوقی به تعداد 14 نفر بودند. روش‌نمونه‌گیری به صورت هدفمند قضاوتی بود و مصاحبه‌ها به صورت نیمه‌ساختاریافته انجام شد. در الگوی نهایی؛ عوامل علی (نقصان نظارتی، نقصان فردی، نقصان رسانه‌ای و نقصان مدیریتی) سبب توجه به پدیده محوری (آسیب شناسی تبانی در فوتبال ایران) و راهبردهای استفاده از آن (فرهنگسازی و بهبود روند عقد قراردادها، ارائه قوانین و بازنگری مستمر، بهبود ابعاد مالی و توسعه ابعاد اطلاعاتی) با لحاظ عوامل مداخله‌گر (مباحث متداخل دولتی، مباحث متداخل بازارهای داخلی، مباحث متداخل فردی و مباحث متداخل ورزشی) و زمینه‌های موجود (فرآیندهای قبل از توافقات و معاملات، فرآیندهای حین توافقات و معاملات و فرآیندهای بعد از توافقات و معاملات) در تحقیق، پیامدهای مثبتی در (کاهش آثار منفی تبانی، ارتقای شایستگی‌های فردی بازیکنان و بهبود فضای ورزش حرفه‌ای) به دنبال دارد. فرهنگ‌سازی ازسوی مسئولین ورزشی کشور در جهت برخورداری از محیطی عاری از هرگونه تبانی داشته باشیم، پیشنهاد می‌شود مدیران ورزشی تیم‌های فوتبال تدابیری برای ایجاد شرایط روحی-روانی ایده‌آل بازیکنان در نظر گرفته و تمرکز آنها را برروی اهداف گروهی متمرکز کنند و درنهایت از سوی متولیان ورزشی و حقوقی کشور، تدابیری در ارتباط با بازنگری و تدوین قوانین مقابله‌ای با تبانی ارائه گردد.

چکیده [English]

The aim of the current research was the legal pathology of conspiracy in Iranian football. Based on the content of the subject and the objectives of the research, it is qualitative and based on data-based theory. The statistical population of the research included 14 football experts in the legal department and pathology of conspiracy . The sampling method was purposeful judgment and the interviews were conducted in a semi-structured manner. In the final pattern; Causal factors (supervisory deficiencies, individual deficiencies, media deficiencies, and management deficiencies) are the reason for paying attention to the central phenomenon (the pathology of conspiracy in Iranian football) and its use strategies (cultivating and improving the process of signing contracts, providing laws and continuous revision, improving financial dimensions). and the development of information dimensions) in terms of intervening factors (intervening government issues, internal market issues, individual issues and sports issues) and existing contexts (processes before agreements and transactions, processes during agreements and transactions and subsequent processes) of agreements and deals) in the research, it has positive consequences in (reducing the negative effects of conspiracy , improving the individual skills of players and improving the atmosphere of professional sports). Cultivation by the sports officials in order to have an environment free from any conspiracy , it is suggested that the sports managers of the football teams consider measures to create the ideal mental-psychological conditions of the players and focus their attention on the group goals and finally by the sports trustees. and laws of the country,
