چکیده
اِعمال نفوذ در رقابت‌های ورزشی از چالش‌های مبتلا به در حقوق بین‌الملل ورزش محسوب می‌شود که به منظور مقابله با آن کنوانسیون شورای اروپا دربارة اِعمال نفوذ در رقابت‌های ورزشی به ابتکار شورای اروپا انعقاد یافته است. از ویژگی‌های این سند بین‌المللی امکان عضویتِ دولت‌های غیر اروپایی است. ایران در زمرة کشورهایی است که شاهد اِعمال نفوذ در رقابت‌های ورزشی داخلی است و تبانی و شرط بندی در گزارشِ رسمی کمیسیون اصل نود مجلس شورای اسلامی انعکاس یافته است. در این راستا می‌توان قبولِ تعهد در قبال این کنوانسیون را به مثابه فرصت سالم سازی قاعده مندِ نظام ورزش کشور برشمرد. این مقاله با استفاده از روش توصیفی ˗ تحلیلی و بهره‌برداری از اسناد بالا دستی، آراء دیوان بین‌المللی داگستری و نظرات علمای برجستة حقوق در پی پاسخ به این پرسش است که در پرتو موانع موجود تا چه حد می‌توان الحاق دولت ایران به این سند بین‌المللی را امکان پذیر دانست؟ یافته‌های این مقاله نشان می‌دهند با اِعمال شرط در قبال استرداد مسلمانان و صدور اعلامیة تفسیری مبنی بر ممنوعیت شرط بندی در نظام حقوقی ایران الحاق میسر است. همچنین در نتیجة الحاق، شاهد ایجاد آگاهی عمومی در قبال اِعمال نفوذ در رقابت‌های ورزشی، تدوین قانون جامع مقابله با اِعمال نفوذ در رقابت‌های ورزشی و ارتقای شفافیتِ مالی نهادهای ورزشی در نظام ورزش ایران خواهیم بود.

Manipulating in sports competitions is among the existing challenges in international sports law, dealt with by the Council of Europe within the Convention on the Manipulation of Sports Competitions. The possibility of non-EU State Membership is among the features of this treaty. Iran is among those countries that face manipulation in sports competitions. Match fixing and Betting has reflected in Parliament’s article 90's Commission's official report. Therefore, the Iranian sports system could benefit from accepting conventional commitments to eliminate defects. What are the odds of Iran's accession to this treaty considering existing obstacles? This article will answer this question using Descriptive - Analytical method and benefits from upstream documents, ICJ Judgments, and doctrine. Findings clarify that invoking reservations on the extradition of Muslims and issuing a declaration on the betting prohibition in the Iranian legal system will pave the way for accession. The accession will cause public awareness of manipulating sports competitions and codifying a concerning comprehensive code, and improvement of transparency in sports institutions in the Iranian legal system.
