چکیده

این پژوهش به دنبال دستیابی به تدابیر پیشگیرانه و حمایتی برای زنان بزه‌دیده در جرائم جنسی است و در این راستا، حقوق ایران را بررسی کرده و کاستی‌ها و مشکلات حقوقی در این زمینه را تبیین می‌کند. این پژوهش از نوع مطالعه اسنادی است و متون و مقالات جرم‌شناسی، حقوق جزا، قوانین و قواعد فقهی، قوانین موضوعه و اسناد داخلی نمایه شده در پایگاه‌های معتبر اطلاعاتی را مورد بررسی قرار داده است. پس از گرداوری اطلاعات، تحلیل داده‌ها به شیوة توصیفی و تحلیلی انجام شده است. رویکرد این پژوهش انتقادی است و چالش‌های حقوقی مرتبط با زنان بزه‌دیدة جرائم جنسی را بررسی می‌کند. براساس یافته‌های پژوهش اهم چالش‌های موضوع در نظام حقوقی ایران، ذیل موضوعات عدم تعریف جامع و دقیق از جرائم جنسی، عدم توجه کافی به مفهوم رضایت در جرایم جنسی، عدم وجود سازوکارهای حمایتی کافی برای قربانیان، نگرش‌های فرهنگی و اجتماعی منفی نسبت به قربانیان. در نهایت راهکارهایی چون اصلاح قوانین و مقررات، ارتقای آگاهی عمومی، تقویت سازوکارهای حمایتی، ارتقای همکاری بین‌المللی و تقویت نقش جامعه مدنی به عنوان اهم روش‌های برون‌رفت از چالش‌های این حوزه ارائه شده است.

چکیده [English]

This research seeks to achieve preventive and protective measures for women victims of sexual crimes, and in this regard, examines Iran's laws and explains the shortcomings and legal problems in this field. This research is a documentary study and it has examined the texts and articles of criminology, criminal law, jurisprudence laws and rules, subject laws and internal documents indexed in reliable databases. After collecting information, data analysis has been done in a descriptive and analytical way. The approach of this research is critical and examines the legal challenges related to women victims of sexual crimes. Based on the findings of the research, the main challenges of the subject in Iran's legal system, under the topics of lack of a comprehensive and accurate definition of sexual crimes, insufficient attention to the concept of consent in sexual crimes, lack of sufficient support mechanisms for victims, negative cultural and social attitudes towards victims. . Finally, solutions such as amending laws and regulations, promoting public awareness, strengthening support mechanisms, promoting international cooperation, and strengthening the role of civil society have been presented as the most important ways to overcome the challenges of this field.
