Abstract

The Court of Arbitration for Sport, as an international authority for resolving sports disputes, was formed with the aim of ensuring justice, integrity and impartiality in the judicial processes and today plays a pivotal role in handling claims related to contracts, transfers, doping and disciplinary issues. In contrast, the Football Federation of Iran, as the national institution in charge of football, has dedicated committees and disciplinary authorities that deal with internal football disputes by relying on internal regulations and FIFA regulations.

With the aim of a comparative analysis of these two legal systems, this study has examined the decisions issued by the CAS and the authorities of the Iranian Football Federation from reliable sports sources. The comparisons show that the CAS has higher structural and procedural independence and its decisions are considered binding at the international level, while domestic authorities are more influenced by national structures and internal regulations and the possibility of appealing their decisions is limited. This comparative analysis indicates that modeling international standards and strengthening the independence of domestic authorities can enhance the efficiency and legitimacy of the sports litigation system in Iran.

The research method is descriptive-analytical with a comparative approach which first, using a descriptive approach, the concepts, institutions, regulations, and procedures governing the handling of football lawsuits in the two systems under study are identified and explained, and the structure, jurisdiction, hearing procedures, hierarchy of authorities types of lawsuits that can be filed, and the characteristics of the decisions issued are systematically analyzed.
